1. Purpose of the ITR system<\/p>\n

\n
\n <\/p>\n

The Internet Test Room system (“ITR”) is an online platform provided by Test Dimensions Publishers that enables professional users to administer, score, process, and report psychological tests.<\/p>\n

\n
\n <\/p>\n

The ITR system is intended exclusively for professional and organizational use, such as by HR professionals, recruiters, career counselors, psychologists, and other qualified practitioners.<\/p>\n

\n
\n <\/p>\n

The ITR system is not intended for consumer or personal use.<\/p>\n

\n
\n <\/p>\n

\n
\n <\/p>\n

2. Parties and acceptance<\/p>\n

\n
\n <\/p>\n

This Usage Agreement constitutes a legally binding agreement between:<\/p>\n

\n
\n <\/p>\n

– Test Dimensions Publishers, part of Quopt IT Services B.V. (“Test Dimensions”), and<\/p>\n

– The professional user or organization using the ITR system (“Customer”).<\/p>\n

\n
\n <\/p>\n

By accessing or using the ITR system, the Customer confirms that they are authorized to enter into this agreement on behalf of their organization and agree to be bound by its terms.<\/p>\n

\n <\/p>\n

3. Roles under data protection laws<\/p>\n

\n
\n <\/p>\n

For all processing of personal data carried out via the ITR system:<\/p>\n

\n
\n <\/p>\n

– The Customer acts as the data controller, determining the purposes and means of processing.<\/p>\n

– Test Dimensions acts as a data processor, processing personal data solely on the documented instructions of the Customer.<\/p>\n

\n
\n <\/p>\n

The Customer is responsible for compliance with all applicable data protection, employment, and professional regulations in the jurisdictions in which they operate.<\/p>\n

\n <\/p>\n

\n <\/p>\n

4. Customer responsibilities<\/p>\n

\n
\n <\/p>\n

The Customer is solely responsible for:<\/p>\n

\n
\n <\/p>\n

– Lawful collection and use of personal data entered into the ITR system<\/p>\n

– Providing required notices to data subjects<\/p>\n

– Obtaining valid consent where required<\/p>\n

– Ensuring a lawful basis exists for processing, including special-category data<\/p>\n

– Proper and professional interpretation and use of test results<\/p>\n

Test Dimensions does not determine assessment purposes and does not make decisions about individuals.<\/p>\n

\n <\/p>\n

5. Categories of data processed<\/p>\n

\n <\/p>\n

Depending on configuration and use, the ITR system may process:<\/p>\n

\n
\n <\/p>\n

– Identification data such as name, email address, or candidate reference number<\/p>\n

– Test responses and assessment results<\/p>\n

– Psychological, personality, aptitude, or skills-related data<\/p>\n

– Demographic data provided by or on behalf of the data subject<\/p>\n

– Technical and system usage data<\/p>\n

6. Special-category data<\/p>\n

The ITR system may process special-category personal data, including psychological characteristics.<\/p>\n

The Customer is fully responsible for ensuring that all legal requirements for processing such data are met, including obtaining explicit consent where required by law.<\/p>\n

7. Security and confidentiality<\/p>\n

\n <\/p>\n

Test Dimensions implements appropriate technical and organizational measures to protect personal data, including:<\/p>\n

\n
\n <\/p>\n

– Controlled and restricted access to systems<\/p>\n

– Secure hosting environments<\/p>\n

– Encrypted network connections<\/p>\n

– Safeguards against unauthorized access or disclosure<\/p>\n

\n
\n <\/p>\n

Access to personal data is limited to authorized personnel and service providers strictly as required to deliver the services.<\/p>\n

\n
\n <\/p>\n

\n <\/p>\n

8. Sub-processors<\/p>\n

\n <\/p>\n

Test Dimensions may engage carefully selected sub-processors for hosting, maintenance, and technical support.<\/p>\n

\n <\/p>\n

All sub-processors are subject to contractual obligations ensuring an appropriate level of data protection consistent with this agreement.<\/p>\n

\n <\/p>\n

\n <\/p>\n

9. Use of test results<\/p>\n

\n
\n <\/p>\n

The ITR system provides automated scoring and reporting based on validated psychological instruments.<\/p>\n

\n
\n <\/p>\n

Test Dimensions:<\/p>\n

\n
\n <\/p>\n

– Does not provide legal, medical, clinical, or employment advice<\/p>\n

– Does not make automated decisions about individuals<\/p>\n

– Is not responsible for conclusions drawn or actions taken based on test results<\/p>\n

\n
\n <\/p>\n

All interpretation and use of results remain the responsibility of the Customer.<\/p>\n

\n
\n <\/p>\n

\n
\n <\/p>\n

10. Prohibited use<\/p>\n

\n
\n <\/p>\n

The Customer may not use the ITR system for:<\/p>\n

\n
\n <\/p>\n

– Unlawful or discriminatory purposes<\/p>\n

– Automated scraping, reverse engineering, or system abuse<\/p>\n

– Use outside the scope of the agreed license<\/p>\n

– Use in violation of applicable laws or professional standards<\/p>\n

\n
\n <\/p>\n

Test Dimensions reserves the right to suspend or terminate access in case of misuse.<\/p>\n

\n
\n <\/p>\n

\n
\n <\/p>\n

11. Availability and continuity<\/p>\n

\n
\n <\/p>\n

Test Dimensions makes reasonable efforts to ensure the availability and reliability of the ITR system but does not guarantee uninterrupted or error-free operation.<\/p>\n

\n
\n <\/p>\n

Maintenance, updates, or technical issues may result in temporary unavailability.<\/p>\n

\n
\n <\/p>\n

\n
\n <\/p>\n

12. Liability<\/p>\n

\n
\n <\/p>\n

Test Dimensions is not liable for damages arising from:<\/p>\n

\n
\n <\/p>\n

– Incorrect or unlawful use of the ITR system<\/p>\n

– Incorrect data entered by the Customer<\/p>\n

– Misinterpretation or misuse of test results<\/p>\n

\n
\n <\/p>\n

Any liability of Test Dimensions is limited to the extent permitted by applicable law and does not apply in cases of willful misconduct or gross negligence.<\/p>\n

\n <\/p>\n

\n <\/p>\n

13. Data return and deletion<\/p>\n

\n
\n <\/p>\n

Upon termination of the Customer’s use of the ITR system, personal data will be deleted or returned in accordance with contractual agreements, unless retention is required by applicable law.<\/p>\n

\n <\/p>\n

14. Governing law<\/p>\n

\n
\n <\/p>\n

This agreement is governed by the laws of the Netherlands.<\/p>\n

Any disputes shall be submitted to the competent courts in the Netherlands.<\/p>\n

\n <\/p>\n

15. Changes to this agreement<\/p>\n

\n
\n <\/p>\n

These services are intended solely for professional and organizational use<\/strong> by qualified users.<\/p>\n

3. Roles under data protection laws<\/h2>\n

For the services provided:<\/p>\n

The customer\/user acts as the data controller<\/strong> Test Dimensions acts as the data processor<\/strong>Test Dimensions processes personal data:<\/p>\n

only on documented instructions from the customer only for the purpose of providing the agreed services<\/p>\n

The customer is responsible for:<\/p>\n

determining the purpose of processing ensuring a valid legal basis compliance with applicable data protection laws<\/p>\n

4. Categories of personal data<\/h2>\n

Depending on customer use, the following categories of personal data may be processed:<\/p>\n

Identification data (e.g. name, email address) Test responses and results Psychological, personality, and skills-related data Demographic data Technical and usage data<\/p>\n

The exact scope of data is determined by the customer.<\/p>\n

5. Purpose of processing<\/h2>\n

Test Dimensions processes personal data solely on behalf of the customer and within the scope of the agreed services.<\/p>\n

Processing is limited to:<\/p>\n

providing and maintaining the ITR system administering, scoring, and reporting assessments technical support and system management ensuring system security, availability, and continuity<\/p>\n

Test Dimensions processes personal data only on instructions from the customer and does not independently determine:<\/p>\n

the purposes of processing the means of processing, except where necessary for technical delivery<\/p>\n

Test Dimensions does not use personal data for its own purposes.<\/p>\n

However, Test Dimensions may use anonymized data<\/strong> for:<\/p>\n

statistical analysis quality improvement (re-)norming research<\/p>\n

provided that such data cannot be directly or indirectly linked to an identifiable individual<\/strong>.<\/p>\n

6. Special-category data<\/h2>\n

The ITR system may process special-category personal data (e.g. psychological data).<\/p>\n

Such processing occurs only:<\/p>\n

on instruction from the customer for purposes determined by the customer within the technical operation of the service<\/p>\n

Test Dimensions does not determine:<\/p>\n

which special-category data is processed the purpose of such processing whether the processing is lawful<\/p>\n

The customer is solely responsible for:<\/p>\n

establishing a valid legal basis obtaining explicit consent where required complying with all applicable laws and regulations<\/p>\n

The customer warrants that the processing of such data is lawful.<\/p>\n

7. Confidentiality<\/h2>\n

Test Dimensions processes personal data confidentially.<\/p>\n

Test Dimensions ensures that:<\/p>\n

personnel with access are bound by confidentiality obligations access is limited to what is necessary appropriate organizational safeguards are in place<\/p>\n

Confidentiality obligations may be overridden where necessary for:<\/p>\n

the provision of services legal obligations orders from competent authorities<\/p>\n

8. Security<\/h2>\n

Test Dimensions implements appropriate technical and organizational measures, including:<\/p>\n

encrypted communications (TLS or higher) access controls basic logging and monitoring secure hosting environments<\/p>\n

The customer acknowledges that:<\/p>\n

absolute security cannot be guaranteed the measures taken are appropriate given the nature and scope of the services<\/p>\n

The customer further acknowledges that these measures provide an adequate level of security for the intended use.<\/p>\n

9. Data breach notification<\/h2>\n

In the event of a personal data breach:<\/p>\n

Test Dimensions will notify the customer without undue delay Test Dimensions will take reasonable steps to mitigate the impact<\/p>\n

The customer is responsible for:<\/p>\n

assessing the breach notifying regulators (if required) informing affected individuals<\/p>\n

The customer remains responsible for breaches arising within its own systems, processes, or use of the services.<\/p>\n

Test Dimensions is not responsible for:<\/p>\n

breaches outside its infrastructure misuse or improper handling by the customer<\/p>\n

Test Dimensions has no obligation to actively monitor for data breaches within the customer\u2019s systems.<\/p>\n

10. Sub-processors<\/h2>\n

Test Dimensions may engage third parties (e.g. hosting providers).<\/p>\n

Test Dimensions:<\/p>\n

selects sub-processors with due care ensures appropriate safeguards are in place<\/p>\n

The customer grants general authorization for the use of sub-processors.<\/p>\n

Test Dimensions reserves the right to replace or change sub-processors.<\/p>\n

11. International data transfers<\/h2>\n

Where personal data is transferred outside the European Economic Area (EEA) or other relevant jurisdiction:<\/p>\n

appropriate safeguards will be implemented in accordance with applicable data protection laws to the extent reasonably required of Test Dimensions<\/p>\n

12. Data retention and deletion<\/h2>\n

Personal data is retained only as long as necessary for the provision of services or as agreed with the customer.<\/p>\n

The customer is primarily responsible for managing, exporting, and deleting data within the system.<\/p>\n

Upon termination of services:<\/p>\n

the customer will have a reasonable period to export and delete data Test Dimensions will thereafter delete or disable access to the data<\/p>\n

unless legal obligations require otherwise.<\/p>\n

Test Dimensions is not responsible for retaining data after termination. The customer is responsible for securing any required copies.<\/p>\n

Test Dimensions is not obliged to actively migrate or deliver data unless explicitly agreed in writing.<\/p>\n

13. Assistance<\/h2>\n

Test Dimensions provides reasonable assistance upon request regarding:<\/p>\n

data subject requests data protection impact assessments (DPIAs) security incidents<\/p>\n

provided that:<\/p>\n

such assistance is technically feasible it does not impose disproportionate burden<\/p>\n

Assistance is subject to availability of capacity and may be charged.<\/p>\n

14. No direct relationship with data subjects<\/h2>\n

Test Dimensions has no direct relationship with individuals whose data is processed.<\/p>\n

All requests from data subjects must be directed to the customer.<\/p>\n

15. Customer responsibility<\/h2>\n

The customer is fully responsible for:<\/p>\n

lawful use of the services compliance with applicable laws and regulations interpretation and use of test results<\/p>\n

Test Dimensions provides tools and services only and does not make decisions about individuals.<\/p>\n

16. Liability<\/h2>\n

To the extent permitted by law:<\/p>\n

liability of Test Dimensions is limited as set out in its general terms and conditions Test Dimensions is not liable for indirect, consequential, or regulatory damages<\/p>\n

The customer indemnifies Test Dimensions against third-party claims arising from:<\/p>\n

unlawful processing by the customer misuse of the services<\/p>\n

This includes claims and damages related to the processing of personal data.<\/p>\n

17. Changes<\/h2>\n
